Terms of Service

1. Agreement
By creating an account or using MyCloudAlly (the "Service"), you agree to these Terms and to our Acceptable Use Policy. If you don't agree, don't use the Service.
2. The Service
MyCloudAlly provisions and manages a private server ("your Box") running an AI assistant you reach via Telegram, plus web hosting on a subdomain we provide. We manage the infrastructure, updates, monitoring, and backups.
3. Your AI account
The assistant runs on your own third-party AI subscription (e.g. Claude), which you connect. You are responsible for that account, its terms, and its usage limits. We are not your AI provider and are not responsible for the AI's outputs.
4. Your content and conduct
You are solely responsible for everything you create, run, store, or host on your Box. You agree not to use the Service to: (a) violate any law; (b) send spam or unsolicited bulk messages; (c) host or distribute malware, phishing, or infringing material; (d) mine cryptocurrency or run abusive workloads; (e) attack, scan, or disrupt others; or (f) store others' personal data unlawfully. You will comply with our Acceptable Use Policy as updated from time to time.
5. Intellectual property; no reverse-engineering or resale
The Service — including its provisioning system, management tooling, agent configuration, software, scripts, and design — is our confidential and proprietary property. You receive a limited, non-exclusive, non-transferable right to use the Service for your own purposes only. You may not, directly or indirectly: (a) copy, reproduce, or republish the Service's software or configuration; (b) reverse-engineer, decompile, or attempt to derive the Service's source, structure, or methods; (c) resell, sublicense, white-label, or operate a competing or substantially similar service based on the Service; or (d) extract, exfiltrate, or repurpose the Service's internal code, prompts, or tooling. Your own content and projects remain yours; this section covers our platform, not your work.
6. Fees and cancellation
Fees are billed in advance on a recurring basis and are non-refundable except where required by law. You may cancel anytime; access continues through the end of the paid period.
7. Data, backups, and deletion
We take routine backups for operational resilience; they are not a substitute for your own backups. After cancellation, your Box and data are retained for 30 days, then permanently deleted. You may request earlier deletion.
8. Suspension and termination
We may suspend or terminate the Service immediately for violations of these Terms, abuse, non-payment, or risk to the Service or others. We may remove infringing or abusive content.
9. No warranty
The Service is provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or content. Our total liability for any claim is limited to the fees you paid in the 3 months before the claim.
11. Changes
We may update these Terms; material changes will be posted, and continued use means acceptance.
12. Governing law
These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules.
